Congress giveth and I.R.S. taketh away…

Last Thursday the IRS issued Notice 2020-32 which says that expenses paid with Paycheck Protection Program (PPP) loan proceeds are not tax deductible to the extent the loan is forgiven.
This is based on Revenue Code Sections 162, 265, their regulations, and related case law.
As a CFO I anticipated that any loan forgiveness under the CARES Act would have to be treated as income. But was it necessary to say any expenses paid for with the proceeds from the PPP loan are not tax deductible to the extent the loan is forgiven instead of keeping it simple and just saying any PPP loan amount forgiven will considered taxable income?
For most companies who have been approved for a PPP loan this is going to be a moot issue as they will probably be recognizing a significant loss this fiscal year.
Some will argue that this is not the intent Congress had in mind when passing the CARES Act and that the I.R.S. is negating the effect of the CARES Act.
This might be a revelation for many, including lawmakers, the function of the I.R.S. is to maximize the revenue collected under the laws enacted by Congress.
Some lawmakers are saying that they need to fix this, why didn’t they think of this in the first place?
